General Terms and Conditions

  1. These general terms and conditions (“Terms”) apply to both competitions to be featured on the MySpace Mars Planets Radio shows (the “Show”): (a) to have your music on the show (the “Music Competition”) and (b) to be Alex Zane’s co-presenter for one or more episodes of the Show (the “Co-Presenting Competition”) (together, the “Competitions”). Entries to the Competitions must comply with all of these terms and conditions; any that do not will not be considered.
  2. The promoter of the Competitions is Fox Interactive Media UK Ltd, 55 New Oxford Street, London WC1A 1BS (company number 5681734).
  3. Valid entries may only be made by individuals resident in the UK or Republic of Ireland over the age of 14 (in the case of the Co-Presenting Competition) or artists consisting of individual(s) over the age of 14 (in the case of the Music Competition), in each case with a MySpace profile and with the MySpace Mars Planets Radio profile in their top 8 friends.
  4. All entries must be made from content that is uploaded by you to the MySpace Services (as defined in the TOU) and must be in accordance with the MySpace Terms of Use at www.MySpace.com/index.cfm?fuseaction=misc.terms (the “TOU”). By entering either of the Competitions, you confirm that your entry has been made in accordance with, and that you will at all times abide by, the TOU.
  5. There are no cash alternatives to the prizes on offer, no cash payment will be made to any winners of either of the Competitions and the prizes are not transferable.
  6. Entries to the Competitions will not be accepted after 6.00pm on 3rd December 2008.
  7. The promoter accepts no responsibility for any entries that are not received for any technical or other reason whatsoever.
  8. A list of winners will be available on the MySpace Mars Planets Radio profile page until 8th December 2008
  9. Winners may be required to participate in future publicity.
  10. By participating in either Competition, an entrant agrees to be bound by these Terms and those relating specifically to the Competition(s) they have entered.
  11. These Terms shall be governed by the law of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the English Court.

 

The following terms apply only to the Music Competition:

Music Competition Only
.

  1. The prize is to have your track featured on an episode of the Show.  Between five and six tracks will be selected to feature in each episode.
  2. To enter, you must be an artist (either a solo musician or in a band) and have an artist MySpace profile with the track that you want to submit (the “Track”) uploaded into the music player on your page. To submit the Track, you will need to go to the MySpace Mars Planets Radio profile page and submit your name, Band/Artist name, Track name, MySpace URL and email address, and place MySpace Mars Planets Radio within your top 8 friends.
  3. The performer(s) and composer(s) of the Track must not have any type of contract restricting them from entering this competition and complying with all of the Terms, including without limitation a music publishing agreement or a recording contract.
  4. Sound recordings embodying compositions administered by the MCPS-PRS or any  affiliated society or analogous organisation (including without limitation ASCAP, BMI, APRA, GEMA, SACEM or SGAE) and sound recordings administered by PPL or any affiliated society or analogous organisation (including without limitation  SoundExchange, PPCA, SCPP,SPPF or GVL) are not eligible for entry.
  5. The Track must be [original and]:
    1. submitted by the composer(s) of the Track or submitted with the irrevocable consent of the composer(s) of the Track ; and
    2. submitted by the owner(s) of the sound recording of the Track or submitted with the irrevocable consent of the owner(s) of the sound recording of the Track.
  6. A panel of judges (“The Panel”) consisting of Alex Zane and representatives from the promoter, Mars and USP Content will select the tracks that, in their opinion and at their absolute discretion, are most suited to the tone and style of the show. The Panel’s decision is final and no correspondence will be entered into.
  7. If your Track is selected you will be sent a MySpace message notifying you, and requesting further contact details. You will be required to submit the Track to the production company with in a high quality (320kbps) MP3 or equivalent digital audio file, free of digital rights management. You will receive no payment for the use of your Track in the Show.  You will also need to sign a further agreement with the production company granting, and confirming that you are able to grant, a worldwide, perpetual, irrevocable, non-exclusive, royalty-free licence for the Track to be communicated to the public through the MySpace Mars Planets Radio show widget throughout the MySpace Services (as defined in the TOU).
  8. If your Track has been selected, and you have complied with all of the Terms of this competition, you will be sent a confirmation of estimated webcasting date of your Track. This confirmation will be indicative only, and does not guarantee the precise date or time of the webcast.

The following terms apply only to the Co-Presenting Competition:

Co-Presenting Competition Only

  1. The prize is to co-present one or more episodes of the Show with Alex Zane. 
  2. To enter, you must upload an original two minute video clip to the submission page on the MySpace Mars Planets Radio MySpace page, of you reporting/presenting on a subject of your choice or acting out a piece of your own drama or comedy work.
  3. Your video clip must be your wholly original work and may not contain or constitute:
    1. racism or bigotry;
    2. hate speech;
    3. physical threats of any kind;
    4. harassment;
    5. libel;
    6. copyright infringement;
    7. gratuitous profanity;
    8. nudity;
    9. obscenity; or
    10. spam.
  4. The Panel will select the entrants that, in their opinion and at their absolute discretion, are most suited to the tone and style of the Show. The Panel’s decision is final and no correspondence will be entered into.
  5. If you are selected to record a Show you will be sent a MySpace message notifying you and requesting further contact details. You will need to be available to record the Show at a date and time notified to you not less than one week before the scheduled recording.  Reasonable travel expenses for getting to and from the recording studio will be reimbursed by the promoter.  You will be responsible for all other associated costs including but not limited to any accommodation required.  You will receive no payment for your time.  Any artists between 14 and 18 years old must be accompanied to the recording by an adult/guardian.  You will also need to sign a further agreement with the production company containing any further terms that they reasonably deem necessary.
  6. Each week the current co-presenter will be entered into a "Stay or Go" competition. The “Stay or Go” competition will operate on the basis of a MySpace community vote through the MySpace Mars Planets Radio profile. If the higher percentage of the public vote is “Stay” the current co-presenter will be invited to present the following week’s show. If the higher percentage of the public vote is “Go” the current co-presenter will be replaced by the next selected co-presenter for the following week’s show. Results will be collated and verified by the promoter, and no correspondence will be entered into.  The "Stay or Go" competition will run during the period 19:00 each Thursday until 23:59 the following Monday, between 12th June 2008 and 11th December 2008. 

 

 

Free Chocolate Friend Prize Draw Terms and Conditions

  1. Promotion open to UK and Republic of Ireland residents aged 14 or over who are registered as a member of MySpace, excluding employees of Mars and MySpace, their families, agents, and anyone else professionally connected with this promotion.
  2. To enter simply add the "MySpace Mars Planets radio" profile page to your MySpace friends list.  MySpace members who are listed as a friend of "MySpace Mars Planets radio" at 11:59pm on the day before the prize draw in question will be entered automatically into that prize draw.  Last date for entry is 11:59pm on 1st December 2008.
  3. There is one box of Mars Planets (containing 36 x 37g bags) to be won per prize draw.
  4. There are 7 separate prize draws.  The draws will take place on the first Tuesday of every month between June and December (3rd June, 1st July, 5th August, 2nd September, 7th October, 4th November and 2nd December 2008).
  5. Once listed as a "My Space Mars Planets radio" friend you will be entered into each prize draw that takes place while you remain listed.  You do not need to relist as a friend for each draw. 
  6. The prize draws will be supervised by an independent person and the prize will be allocated to the first name drawn at random from all of the MySpace Mars Planets radio friends as at 11:59pm on the day before that draw.
  7. The winner of a draw will be notified within 14 days of the draw in which they are selected and will be contacted by MySpace via email to arrange delivery of their prize.  The winner’s email address will be obtained from winner’s MySpace profile page and their personal details will be used for the purposes of administering the promotion only.  By participating in this promotion, an entrant agrees to be contacted by MySpace by email, if selected as a winner.
  8. The winner will receive their prize within a further 28 days from providing their delivery details and accepting their prize.
  9. The monthly prize is as stated, is non-transferable, and no cash alternative is available.
  10. The result of each prize draw is final and binding in all matters and no correspondence will be entered into. 
  11. The name and county of a winner will be listed on the "MySpace Mars Planets radio" profile page once the winner has confirmed acceptance of their prize.
  12. The Promoter accepts no responsibility for names that are omitted from the list of "MySpace Mars Planets radio" friends entered into a monthly prize draw for any technical or other reason whatsoever.  
  13. The Promoter reserves the right to award an alternative prize of equal or greater value should the prize become unavailable for any reason.
  14. The Promoter reserves the right to cancel, amend, terminate or temporarily suspend this promotion in the event of any unforeseen circumstances outside its reasonable control.
  15. Prizewinners may be required to participate in related publicity.
  16. By taking part in this promotion, entrants agree to be bound by these terms and conditions.
  17. This promotion shall be governed by, and construed in accordance with, the laws of England and Wales.
