WHEN IN ROME “Meet Kristen Bell Sweepstakes” (the “Sweepstakes”)
1. SPONSOR/HOST: Sponsor/Administrator: ABC, Inc., dba Walt Disney Studios Motion Pictures, 500 South Buena Vista St., Burbank, CA 91521 (the “Sponsor”). MySpace, Inc. (“MySpace" or “Host”), 407 N. Maple Drive, Beverly Hills, CA 90210.
2. ENTRY: During the period commencing at 5:00:00 P.M., January 13, 2010, and ending at 5:00:00 P.M., January 20, 2010 (“Entry Period”), you will be automatically entered into the Sweepstakes if you do all of the following: (1) sign into your MySpace account (“Account”) or, if you are not already a member, become a member of MySpace.com and sign into your account; and (2) go to http://www.myspace.com/wheninromemovie and click on the link “Click Here to Enter” (collectively, “Entry”). Your Account must remain active during the entire Entry Period with a current email address associated with the Account and your Account settings must be set to allow you to receive messages from Sponsor and Host in order for you to be eligible to win the Sweepstakes. Normal Internet access and usage charges imposed by your online service will apply. For purposes of these Official Rules (“Rules”), all times and days are Pacific Time.
3. LIMITATIONS: All Entries must be received by 5:00:00 P.M., January 20, 2010. Only one Entry per person/Account (regardless of whether one person has more than one Account or more than one person use the same Account). In event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the natural person who is the “authorized account holder” assigned to the Account by MySpace. Entries by any method other than set forth above in Section 2 are void. Use of any automated system to enter as determined by Sponsor in its sole judgment is prohibited and will result in disqualification at Sponsor’s sole discretion. Open only to persons who, upon entering, are 13 years or older; legal residents of, and physically located within, the 50 United States or D. C. (excluding residents of Maine who are younger than 18) (collectively, “Territory”); and not employees of Sponsor or Host; their parent, subsidiary, affiliated or successor companies; the advertising, promotional or fulfillment agencies of any of them (individually and collectively, “Entities”) nor members of their households or immediate families. Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, “Releasees”) are responsible for Entries from persons residing, or physically located, outside the Territory, or Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, illegible, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misdirected, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Rules; or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable emails resulting from any form of active or passive email filtering; insufficient space in entrant’s email account to receive email; or other errors of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified and any attempt by a person to use multiple Accounts to register more than once may result in disqualification at Sponsor’s sole discretion. Void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations.
4. PRIZE: One (1) GRAND PRIZE: Subject to the eligibility and forfeiture provisions set forth in these Rules, the winner (“Prize Winner”) will receive a round trip coach air ticket on an “if-used” basis (to be arranged by the Sponsor) for the Prize Winner and one (1) guest between the airport nearest the Prize Winner’s city of residence within the Territory and Los Angeles, California; hotel accommodations for Prize Winner and guest in Los Angeles, California (1 room, double occupancy on an “if-used” basis) for such number of nights as the Sponsor shall designate in its sole discretion (the “Trip”); and the opportunity for Prize Winner and guest to attend a taping of the television show, “Jimmy Kimmel Live!” and meet the actress Kristin Bell on or about January 26, 2010, subject to availability (in Sponsor’s sole discretion) ( the “Grand Prize”). The Prize Winner and guest must travel together on the same itinerary for air transportation. If the Prize Winner is a minor, he/she may not participate in the trip unless the guest is his/her parent or legal guardian. If the Prize Winner’s guest is a minor, such guest may not participate in the trip unless the Prize Winner is the parent or legal guardian of the minor guest. Dates and locations of the taping and meeting with Kristin Bell are subject to change, in the Sponsor’s sole discretion. If a prize cannot be awarded due to circumstances beyond the control of Sponsors, a substitute prize of equal or greater retail value may be awarded; provided, however, that in the event Kristin Bell is unavailable during the Trip for any reason, or the Jimmy Kimmel Live! show is cancelled or unavailable, related portions of the Grand Prize may be cancelled without substitution or compensation. Approximate retail value: $4,000. Prize is not redeemable for cash or transferable. The prize cannot be used in conjunction with any other promotion or offer.
5. PROCEDURES: All Entries must be received during the Entry Period. On or about January 21, 2010, in a random drawing, the potential winner will be selected from all eligible Entries received. Odds of winning depend on the total number of eligible Entries received.
6. WINNER: Potential winner will be notified by MySpace or Sponsor by email to the email address on file on the potential winner’s Account or by MySpace message on or about January 21, 2010. Sponsor and Host are not responsible for changes to the MySpace email or messaging functionality that may interfere with winner notification. To claim the prize, you will be required to provide additional information in order for Sponsor to fulfill the Prize. All legal responsibilities under the Rules of a minor (as defined by state of primary residence, “Minor”) will be assumed by a parent/legal guardian (“Parent”); and a Minor winner’s prize will be awarded in the name of the Parent for the benefit of the Minor. At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: [1] potential winner’s failure to respond to notification within twenty-four (24) ) hours after its transmission in the format of response requested by Sponsor; [2] the failure of notification due to deactivation of the potential winner’s Account prior to receipt of notification; [3] potential winner’s failure to follow all the steps of the Entry, resulting in the potential winner’s failure to receive an email or MySpace message from Sponsor or Host; [4] potential winner’s Account settings are set so that the potential winner’s responses may not be received by Host or Sponsor; [5] potential winner’s failure to provide Sponsor with satisfactory proof of age, identity and residency; [6] potential winner’s failure to execute and return an Affidavit of Eligibility/Liability/Publicity Release within twenty-four (24) hours after it is mailed; [7] any other non-compliance with Rules. In the event of a prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited prize to an alternate winner. All taxes are solely the responsibility of the winner (or Parent if a Minor), who will receive an IRS Form 1099 reflecting the value of the prize.
7. PRIVACY POLICY/DATA COLLECTION: Information provided by you for this Sweepstakes is subject to Host’s privacy policy located at www.myspace.com/index.cfm?fuseaction=misc.privacy. By entering the Sweepstakes, you grant MySpace permission to share your email address and any other personally identifiable information with the Sponsor solely for the purpose of administration and prize fulfillment. MySpace will not sell, rent, transfer or otherwise disclose your personal data to any third party other than the Sponsor as described above herein.
8. CONDITIONS: By entering this Sweepstakes and/or accepting any prize you may win, you agree, represent and warrant that: [1] you will be bound by the Rules and the Sponsor’s decisions, which shall be final in all respects; [2] the Entry becomes solely the Sponsor’s property and will not be acknowledged or returned; [3] you release and hold harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of the prize; participation in the Sweepstakes or any Sweepstakes-related activity or travel or from any interaction with, or downloading of, computer Sweepstakes information; [4] the Releasees do not make any representation, warranty or guarantee, express or implied, relating to the Sweepstakes or the prize; [5] winner’s acceptance of the prize constitutes the grant to Sponsor and assigns of an unconditional right to use winner's name, address (city and state only), voice, likeness, photograph, biographical and prize information, statements about the promotion and/or live and taped performances of interviews for any programming, publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; [6] in the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor’s reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of the Sweepstakes, so that it cannot be conducted as originally planned, Sponsor has the right, in its sole discretion, to modify the Rules or to cancel, modify, terminate or suspend the Sweepstakes; and in such event, to select winners by such method as Sponsor in its sole discretion shall consider equitable; [7] the Releasees are not responsible for typographical or other errors in the offer or administration of this Sweepstakes, including but not limited to: errors in the advertising, Rules and selection and announcement of the winner; [8] any portion of the prize not accepted or used by the winner will be forfeited; [9] the Releasees are not responsible for any inability of the winner to accept or use the prize (or any portion thereof) for any reason [10] Sponsor has the right to modify prize award procedures at its sole discretion; [11] the Releasees are not responsible for changes to the MySpace messaging function that may interfere with the Sweepstakes or your ability to timely enter; and [12] Releasees are not responsible for any failure of delivery of winner notification.
9.
